THE SPRINGS BOARD OF DIRECTORS MEETING
13 September 2004

Board Members Present: Mike Kearns, Tom Honmyhr, Paul
Walter, Lee Huey, Mary Yager, Ron Shaffer, Connie Fish and Marge Hurst.
Ernie Cox absent.
Others Present: There were 67 homeowners present.
Welcome and Call to Order: President Tom Honmyhr called
the meeting to order at 10:00 A.M.
Announcements: Tom Honmyhr introduced the Board Members
and Office Manager. Directions were given to the homeowners who would be
speaking: Come to the front, state name and address and feel free to make
comments to the board. There will be one change in the agenda. After the
committee reports we will have the ARC report and discuss the residents
appeal then.
Homeowner’s Comments
•
Dick Carey – 3749 S Calle Rambles He expressed his unhappiness with the 53
letters being sent to homeowners. He discussed the variations in the wood
trim. He would like the board to make an amendment to strip the powers of
Mr. Steindorff.
• Mr. Parker – 3773 S Calle Rambles He discussed why he
bought here and his problems with the ARC in the past. He felt that the
previous HOA board didn’t enforce the CC&R’s but the current board is.
• Maurine Kosnik – 3825 S Camino Comica She discussed the
issue of the paint. The Phase I painting process was different than Phase
II because of the technique that was used. We have faded colors in paint
and wood.
• Bethia Daughenbaugh – 3787 S Paseo De Los Nardos She
discussed the issue of the house colors. She supports a pallet of colors.
She has concerns about being able to change the CC&R’s. She is concerned
about the situations in The Springs: People are not happy, people are
calling board members, people are calling board member’s wives, people are
insulting people, and people are saying that they are not going to serve
on the board. She says it is wrong to attack board members.
• Dave Brown – 3817 S Camino Comica He discussed his
concerns about the letters that were sent out to homeowners for ARC and
weed violations. He stated that Bob Steindorff painted the houses and wood
different colors as they were being built. The wood stain in Springs I was
darker than the wood stain in Springs II. He mentioned the new State
Legislation concerning HOA’s. He said that one of the new bills states
that the HOA must make its books open to inspection. He stated that the
board has always denied this request to the homeowners of the Association.
He talked about a board member that took telephoto pictures of a
homeowner’s backyard. He talked about a letter that he wrote to the board
and the response that he got.
• Milo Weingart – 4103 S Golden Lynx and 3773 S Camino
Comica He discussed his concerns about the developer and the developer’s
rights in the association. He would like to have the model homes sign
removed. He recommended that we get a legal opinion about the developer’s
powers. He discussed the problem of the paint color of his mother’s house.
He recommended that the board look into the cost of a management company.
The HOA seems to have a conflict with House Bill 2381 – a family member of
the board working for the board. Joe Barton - 1004 W Blue Fox Road He
discussed the entrance to The Springs. It looks shabby. He is willing to
volunteer for clean-up. He agrees that the model home signs need to come
down.
• Gene McGaughey – 4083 S Golden Lynx He likes the
structure of the CC&R’s. He feels that homeowners have a responsibility to
follow the CC&R’s. Communication to the HOA Board should be in writing.
Tom Honmyhr’s response to the homeowners:
• Thank you for all your comments. This board would never, ever violate a
law. The books have always been open. The latest law regarding the
relationship of a contractor and board member is very very clear. It is
easy to interpret and easy to read. If a potential conflict exists the
board member needs to announce that at a public meeting and after that has
been announced that board member can either vote on the issue or recluse
himself from the issue and that is the extent of the law.
• We have an attorney that represents 175 HOA’s with 19 years experience
that we go to for legal advice.
• Bob Steindorff: There were amendments that were filed after the first
CC&R’s in 1995/1996. It affirms his right as the declarent. As it stands
right now, he continues to have final say in rules and policy changes. The
policies that we adopt need to be signed by Bob Steindorff. The process to
change the CC&R’s can be read in that document.
• The board members are volunteers. We volunteered because we want to make
this a better place to live. We are having a hard time to get volunteers
to run for the board next year. We have people on the board who have said
“I’ve had enough”.
Secretary’s Report & Minutes – Tom Honmyhr
A motion was made by Paul Walter and seconded by Mike Kearns to approve
the June 22, 2004 minutes as written. The motion passed.
Treasurer’s Report – Paul Walter
He mentioned that the financial books are always open, that the report is
on the website and if anyone wants to get a copy of the report, they can
get it at the HOA office. He reported that total current assets as of
8/31/2004 are $163,608.26; Checking account balance is $651.44; Reserve
account balance is $89,652.99; Saving account balance is $73,303.83. A
motion was made by Mike Kearns and seconded by Lee Huey to accept the
report as written. The motion passed.
Homeowner’s Comments
Quarnig Dorian – 3925 S Camino Del Golfista – He asked what interest rate
are we getting on our savings account. World Savings is paying almost 2%.
A copy of the Treasurer’s report was given to a homeowner.
Dick Carey – 3749 S Calle Rambles – Why do we not belong to the GVCC?
Committee Reports:
Streets & Buildings - Lee Huey
Wood beam on storage shed were painted by Ron Spreigel. He donated his
time & materials. Mike Kearns filled gaps between curbs and sidewalks with
fine gravel. A few sections of our sidewalks are lifting. The hardware on
our street signs and stops signs has been replaced. The gatehouse molding
fell off and I’m looking for suggestions on how to fix it. There are
complaints about street sweeping service. I suggest terminating this
service. The service road area has been used by illegal immigrants and
vehicles have been parked there for their use. A motion to accept the
report was made by Paul Walter and seconded by Mrs. Fish. The motion
passed.
Homeowner’s Comments
Tom Tarpey – 3701 S Avenida De Encino – He wanted to know where
the service road is located.
Pam Le Clair – 1035 Blue Fox – She inquired about the “big X”
that was painted on the road. The Border Patrol indicated that it was done
by homeland security for the satellite system.
Tom Honmyhr – There is also a white X on the golf course the 15th fairway
and is a GPS location. The board did not paint the X’s. Ernie Cox has been
in contact with the Border Patrol about this situation.
Mr. Parker – 3773 S Calle Rambles – Street cleaning is not using water and
should be discontinued.
Lee Huey – The street service doesn’t use water. It does not wash the
streets. The water is used only to keep down the dust.
Nancy O'Connell – 3878 S Camino Del Golfista – Could we do street service
on demand only.
Lee Huey - We are doing it once a quarter.
Tom Tarpey – 3701 S Avenida De Encino – The water just suppress the dust.
The machine spreads around the dirt.
Additional Comments by President - Tom Honmyhr
It takes an effort to get this community to be the type we want. We need
to start moving forward. The hardest thing to do is to go to your
neighbors and tell them they are not in compliance with the rules. It is
up to all of us to turn this community around and we all must realize that
when we moved here we agreed to live by a certain set of rules.
Architectural Review Committee – Ron Shaffer
He discussed the problems that he experienced. He introduced the members
of the ARC: Richard Olson, Bob Braswell, Mary Yager and Marge Hurst. He
then discussed the process of determining who would receive violation
letters and the responses that the ARC has received. He read excerpts from
the ARC Guidelines that had been written several years ago. He supplied
samples of the paint that Frazee carries. He worked with TruValue in Green
Valley to carry a formula for the paint.
Homeowner’s Comments
Dick Carey – 3749 S Calle Rambles – He wanted to take a vote of the
homeowners present to see if they wanted paint color variations.
Tom Honmyhr – Our job is to enforce the CC&R’s. This is a selective
audience; we will not take a vote.
Nancy O’Connell – 3878 S Camino Del Golfista – She has 3 versions of the
guidelines and they differ. She wants to know what version is accurate.
Tom Honmyhr – The current version is on the Internet.
Dave Brown – 3817 S Camino Comica – He wants to know if the board is
denying that the colors were darker earlier.
Tom Honmyhr – The standards
are the same now as when I moved here 3 years ago. We are trying to
correct some of the mistakes of the previous boards.
Mike Kearns – He challenged people to run for the board. The board members
are following the CC&R’s. We are trying to correct some of the issues that
have been done in the past.
Alene Spriegel – 691 W Calle De La Pelotita – She wanted to know if we are
going to make the homeowners repaint homes to follow the colors.
Ron Shaffer – The ARC didn’t send out letters for different shades of
paint.
Residents appeal of Non-compliance letter
1. Mr. Dorian – 3925 S Camino Del Golfista /3809 S Calle Rambles He
discussed the wood beam on his houses. Ron Shaffer stated that the issue
is that paint was used and not stain. The ARC will review.
2. Mr. Serek – 3795 S Avenida De Los Solmos He discussed the foil on the
garage door windows. Ron Shaffer told Mr. Serek that he can paint the
windows brown.
3. Mr. Wallace Dickerman – 3701 S Comino Del Cefiro He did not show up for
the meeting.
Grounds – Ernie Cox, on vacation.
Old Business:
1. Amend Parking Policy – Tom Honmyhr An amended parking policy was
presented. Paul Walter made a motion, seconded by Mike Kearns, to approve
the amended policy. The motion passed.
2. CC&R Rules Enforcement Policy – Tom Honmyhr An amended rules and
enforcement policy was presented. Paul Walter made a motion, seconded by
Connie Fish, to approve the amended policy. The motion passed.
New Business:
1. Reserve Study Update - Tom Honmyhr We have not received the reserve
study. Hopefully we will receive it by next month’s board meeting.
2. Reimbursement Policy – Tom Honmyhr A Springs Administrative
Reimbursement Policy was presented. Paul Walter made a motion, seconded by
Mike Kearns, to approve the policy. The motion passed.
Homeowners Comments
Jeannie McGaughey – 4083 S Golden Lynx Road – Does this mean that the
board will recover the cost to copy any materials?
Susan Olsen – 3791 S
Camino Del Golfista – Who will pay for the information?
Tom Honmyhr – The
legislation allows the HOA to be reimbursed for costs.
3. Financial Review or Audit – Tom Honmyhr We need
volunteer(s) to review the books.
4. Tree policy on Private Property – Tom Honmyhr The Springs Private
Property Tree Policy was presented. Paul Walter made a motion, seconded by
Ron Shaffer, to approve the policy. There was discussion on the policy.
Tom Honmyhr suggested that we table the motion until the next board
meeting. The board members agreed.
Homeowner’s Comments
Gene McGaughey – 4083 S Golden Lynx Road – He thanked the board for the
great meeting.
Ray May – 1005 W Blue Fox Road – He was concerned about the garbage pick
up as he was told that his garbage should be placed across the street.
Tom Honmyhr – Waste Management should be picking up garbage on both sides
of the street.
A motion was made by Paul Walter and seconded by Mike
Kearns to adjourn. The motion passed.
The meeting was adjourned at 12:25 P.M.
